Jonathan Strobel is believed to have launched the first lawsuit to result from the battery defect affecting Galaxy Note 7 smartphones.

Mr Strobel, of Palm Beach County, Florida, alleges his Samsung Galaxy Note 7 detonated in his right pocket on September 9 and caused “severe burns” to his leg – leaving him “in shock and extreme pain”.

The lawsuit is seeking damages in excess of $15,000, some £11,490 converted.

Amongst other allegations, the suit alleges that Samsung “knew or in the exercise of due care should have known that the Galaxy Note7 cell phone […] would create a foreseeable risk of harm to users.”

A spokesperson for Samsung has confirmed that the South Korean technology company is aware of the incident, but told ABC News that it does not “comment on pending litigation”.

Almost one million Galaxy Note 7 smartphones were sold in the United States alone, with the US Consumer Product Safety Commission estimating that around 97 per cent of those sold contained the defective battery.
